General Terms and Conditions (GTC)
KSL8 Apartments GmbH – trading as “Lovis Suites”

1 Scope of Application
1.1 These GTC govern all agreements for the temporary rental of suites and all ancillary
services provided by KSL8 Apartments GmbH (“Accommodation Provider”) at the property
operated under the trade name Lovis Suites.
1.2 The Austrian Hotel Contract Conditions 2006 (AGBH 2006) apply on a subsidiary basis;
individual terms stated in the booking confirmation prevail.
1.3 Receptionfree operation: All communication is handled digitally. Guests undertake to
respond to messages from the Accommodation Provider between 8 a.m. and 8 p.m. within a
reasonable period to ensure smooth operations.
2 Conclusion of Contract & CreditCard Guarantee
2.1 The accommodation contract is concluded upon acceptance of the reservation (email,
booking platform, OTA, etc.) by the Accommodation Provider.
2.2 Guarantee / Advance Payment: Every booking requires either a creditcard authorisation
or prepayment by bank transfer. Cash or debitcard deposits are not accepted. The exact
amount is displayed during the booking process (currently “tbd”).
2.3 The Accommodation Provider is entitled to collect authorised amounts in the event of
contractual breaches (e.g. noshow) or damage.
3 Services, Prices, Payment
3.1 The Accommodation Provider makes the booked suite available in the condition
described on the website.
3.2 Prices are quoted in EUR and include VAT; local taxes may be shown separately.
3.3 Unless due earlier, the total price must be settled no later than checkout (selfcheckout
process) by the stored credit card or SEPA transfer without deduction. The Accommodation
Provider may charge outstanding amounts at any time.
4 Checkin / Checkout
– Checkin: from 3 p.m. via digital key code.
– Checkout: by 11 a.m. (digital departure).
Late checkout: 50 % of the daily rate until 6 p.m., thereafter 100 %.
5 Cancellation, NoShow & Early Departure
Only the cancellation and prepayment terms displayed during booking (OTA / rate
dependent) apply. In the absence of specific terms, up to 100 % of the booking value may be
charged. Cancellations must be made in writing (email, OTA messenger).
6 Security Deposit & Damage
6.1 To cover potential damage, a security deposit is taken by creditcard preauthorisation or
SEPA transfer either on arrival or before key dispatch (amount shown during booking).
6.2 If damage exceeds the deposit, the Accommodation Provider may immediately charge
the stored credit card for the difference and will issue a detailed invoice to the guest.
6.3 Guests must report damage without delay via email or messenger.
7 Liability, Valuables & Safe Obligation
7.1 No reception – mandatory safe use: Guests must store valuables (especially jewellery,
cash, electronics, travel documents) exclusively in the inroom safe.
7.2 The Accommodation Provider accepts no liability for loss, theft or damage to valuables,
even if the safe is used, insofar as legally permissible.
7.3 Otherwise, the Accommodation Provider is liable only for intent or gross negligence;
liability for slight negligence is excluded except for personal injury.
8 House Rules & Conduct
– Nonsmoking: All interior spaces are smokefree; violation → special cleaning fee
EUR 350,-
– Pets: Allowed only with prior written consent, subject to a fee and proof of petliability
insurance; violation → special cleaning fee EUR 500,-
– Cooking: The preparation of food in the suites and the bringing or use of any cooking
or heating devices (e.g. hotplates, airfryers, rice cookers) is strictly prohibited;
violation incurs a contractual penalty of EUR 500,-
– Quiet hours: 10 p.m. – 7 a.m.
– Fire safety: Do not cover smoke detectors; keep escape routes clear. Violation →
contractual penalty of EUR 250,-
– Communication: Guests must remain reachable during their stay and respond
promptly to enquiries from the Accommodation Provider (technical issues,
emergencies, official requirements). Delayed responses may be deemed a breach of
contract.
9 Illness or Death of a Guest
9.1 If a guest falls ill during the stay, the Accommodation Provider will arrange medical
assistance (at the guest’s request or in an emergency).
9.2 All resulting costs (doctor, medication, ambulance, disinfection, downtime of the suite,
replacement of damaged furnishings, etc.) are borne by the guest or their legal successor.
9.3 In the event of death, the legal successor is liable for all outstanding charges and costs in
accordance with § 16 AGBH 2006.
10 Force Majeure & Alternative Accommodation
In unavoidable exceptional circumstances, the Accommodation Provider may terminate the
contract or provide suitable alternative accommodation without liability for damages.
11 Place of Performance, Governing Law & Jurisdiction
The place of performance is Vienna; Austrian law applies (UN Sales Convention excluded).
The exclusive place of jurisdiction—unless mandatory consumer protection law dictates
otherwise—is the competent court in Vienna.
12 Final Provisions
12.1 Amendments or side agreements must be in writing.
12.2 Should individual clauses be invalid, the remaining provisions remain unaffected; the
statutory rule shall apply in lieu of the invalid clause.
12.3 The current version of these GTC is available at www.lovissuites.com; earlier versions
become void upon publication of an updated version.
By completing a booking, the guest acknowledges and accepts these Terms and Conditions.
